1. Foreword
smarterion takes the protection of personal data seriously. Special attention to privacy when processing and storing personal data is a central concern. Personal data is processed in accordance with the provisions of the European General Data Protection Regulation (GDPR) with effect from 25 May 2018. The websites (collectively “website”) of smarterion may contain links to websites of other providers that are not covered by this privacy policy.

By using the smarterion website, namely by providing your own personal data via the Internet, you confirm that you have taken note of this privacy policy and consent to the processing of your personal data by smarterion in accordance with this privacy policy. This consent can be revoked at any time (see section 16 “Right to object” below).

2. Personal data
Personal data includes all information relating to an identified or identifiable person. It provides information about the identity of a person. This includes information such as name, address, postal address, telephone number, etc. It does not include information that cannot be linked to the identity (such as favourite websites or the number of users of a website).

If you decide to register, you must enter personal information in your individual user profile. You are free to decide whether you wish to enter this data. smarterion uses the personal data for the purposes of technical administration of the website and for user or customer administration only to the extent necessary in each case. Beyond this, personal data is only stored if it is provided voluntarily.

3. Disclosure of personal data
Subject to the legally regulated exceptions, smarterion will not pass on the data to third parties without your consent. If personal data is passed on to service providers in the course of processing, they are bound by the European General Data Protection Regulation (GDPR) and possibly other statutory provisions.

Personal data is only collected or transferred to state institutions and authorities within the framework of mandatory legal provisions.

4. Contact form
If you send smarterion enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by smarterion for the purpose of processing the enquiry and in the event of follow-up questions. Subject to section 2 above, we will not pass on this data without your consent.

5. Newsletter
If you would like to receive the newsletter offered on the website, smarterion requires an e-mail address from you as well as information that allows smarterion to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. No further data is collected. We use this data exclusively for sending the requested information and, subject to section 2 above, do not pass it on to third parties.

You can revoke your consent to the storage of personal data in accordance with section 1 of this privacy policy, in particular your e-mail address and its use for sending the newsletter, at any time, for example via the “Unsubscribe” link in the newsletter.

6. Webshop
smarterion operates a webshop on its website.

The personal data you enter during the ordering process on our website, such as name, address, postal address, telephone number, e-mail address, credit card number, date of birth, etc., will be used by smarterion to the extent necessary for the processing and invoicing of your order.

For the purpose of dispatching your order, smarterion is authorised to transmit your personal data to a forwarding agent, which processes this data on behalf of smarterion and in accordance with the data protection regulations and necessary security regulations. Section 2 of this privacy policy applies accordingly.

7. Security
smarterion endeavours to take appropriate measures to protect your personal data from loss, misuse, unauthorised access, disclosure, alteration or destruction. To this end, smarterion uses suitable technical and organisational security measures, which are continuously improved in line with technological developments. However, smarterion cannot guarantee the absolute security of the data. smarterion accepts no liability for breaches of this security provision, unless they are intentional or due to gross negligence. To ensure confidentiality and security, your data is protected by, among other things, a password chosen by you; you must ensure that only authorised persons have access to your password. For your own security, we recommend that you change your password regularly.

8. SSL encryption
This website uses SSL encryption for security reasons and to protect the transmission of confidential content, such as the enquiries you send to smarterion. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL encryption is activated, the data you send to smarterion cannot be read by third parties.

9. server log files
The provider of our website automatically collects and stores information in so-called “server log files”, which your browser automatically transmits to smarterion. These are in particular

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server enquiry

This data cannot be assigned to specific persons. This data is not merged with other data sources. smarterion reserves the right to check this data retrospectively if specific indications of illegal use become known.

10. Integration of social media plug-ins
Our website contains numerous social media plug-ins, which are usually integrated into our website as graphic files. Each time you visit our website, the buttons are loaded from the social media provider’s website. In this way, it is possible that your IP address and the URL of our website in particular are forwarded to the social media provider’s servers and stored there.

In these cases, smarterion does not disclose the data in accordance with the Swiss Data Protection Act. smarterion has no knowledge of the content of any transmitted data or its use by the social media provider. For further information on data protection (in particular on the scope, type and purpose of data processing), please refer to the data protection declarations of the individual social media providers. There you will also find further information on your rights and setting options to protect your privacy.

You can prevent third-party providers from collecting information about you during your visit by logging out of your social network pages and deleting cookies (see section 13 below).

11. Use of cookies
This website uses mandatory and non-mandatory cookies. Cookies do not harm your computer and do not contain viruses.

Mandatory cookies are data that can be sent to the browser on your computer’s hard drive so that we can offer you certain functions. They do not require the consent of the website user.

We use non-mandatory cookies to collect information about visits to the website. We also use non-mandatory cookies to improve the user-friendliness of the website, for example by saving your password. Non-mandatory cookies require the consent of the website user. Most browsers automatically accept cookies, but you are not obliged to use them. You can usually set your browser to reject cookies while still being able to use most of the website’s functions.

Most of the cookies used by smarterion are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies enable smarterion to recognise your browser on your next visit.

12.2 Purpose
The information generated by the cookie about your use of the smarterion website (including your IP address) will be transmitted to and stored by Google on servers in the United States. The IP address is then shortened by Google by the last three digits, so that it is no longer possible to clearly assign the IP address. Google will use this information to analyse your use of the website, to compile reports on website activity for the website operator and to provide other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.

13. management of cookies (activation, deactivation or deletion)
All web browsers offer the option of activating, deactivating or deleting the use of cookies by configuring the browser settings or options accordingly. The steps required for this vary from browser to browser. In detail:

13.1 Web browser / administration
13.1.1 Internet Explorer
In the browser window, click on the option “Extras, “Settings”, “Privacy”. Privacy settings may be set to a maximum of “Medium” so that cookies are activated in the browser. Settings higher than “Medium” prevent cookies from being stored.

To delete cookies, click on the “General” option after “Settings” and then on “Delete” under “Browsing history”.

13.1.2 Google Chrome
Click on the spanner icon at the top right of the browser window, then on “Settings”, then on “Show advanced settings”, then on “Privacy”, then on “Content settings”, then on “Cookies” and then on “Allow storage of local data” to allow cookies.

To disable cookies, you must tick the options “Block data storage for all websites”, “Block third-party cookies and website data” and “Delete local data after closing the browser”.

13.1.3 Mozilla Firefox
At the top of the browser window, click on “Tools”, then “Settings”, then on the “Privacy” icon and tick the “Accept cookies” box to allow cookies. To deactivate cookies, the tick must be removed.

To delete cookies, click on “Tools” at the top of the browser window, then on “Options”, then on “Privacy” and then on “Delete now”.

13.1.4 Safari
Click on “Safari” at the top of the browser window, then on “Settings”, then on “Privacy” and then on “Block cookies”. If you want to enable cookies, click on the “Never” option.

If you want to disable cookies, click on the “Always” option.

If you click on “Remove all website data” next to “Cookies and other website data” and confirm with “Remove now”, all cookies will be deleted.

If cookies are completely or partially deactivated or deleted, not all functions of the website may be available. If a user uses a web browser not listed above, further information is available in the browser documentation or in the online help.

14. Links to other websites
The smarterion online offer contains links to other websites. smarterion has no influence on whether their operators comply with the data protection regulations. smarterion excludes any responsibility or liability for the websites of third parties that can be accessed via the links.

15. Contributions
The contributions on our site are accessible to everyone. Contributions should be carefully checked before publication to ensure that they do not contain information that is not intended for the public. The contributions may be recorded in search engines and may also be accessible worldwide without specifically calling up this website.

16. Your rights
If you have provided us with personal data, you can assert the following rights at any time, provided that there are no legal regulations to the contrary:

16.1 Right to information
You have the right to obtain information about the data concerning you at any time in order to be aware of the lawfulness of the processing and to check it (Art. 15 para. 1-4). For a complete deletion of your account, please contact smarterion’s data protection contact.

16.2 Right to rectification
If you have provided us with personal data, you have the right to have this data corrected if it is incorrect or incomplete. We will correct this data upon notification.

16.3 Right to erasure (right to be forgotten)
You have the right to have the data stored about you erased if it is no longer required for processing, if it has been processed unlawfully or if you no longer consent to the processing or object to it. In the case of data that is subject to a statutory minimum retention period or if it is required to fulfil a legal obligation or for the exercise or defence of legal claims, smarterion may refuse to delete the personal data requested.

16.4 Right to restriction of processing
You can restrict or block the processing of your personal data if you dispute the accuracy of the data until smarterion has proven the accuracy of such data. This also applies if the processing of your personal data is unlawful and you request the restriction of its use instead of its erasure. The right to restriction of processing can also be exercised if smarterion no longer needs the data, but the data subject needs the data to establish, exercise or defend a legal claim. Processing may also be restricted if the person has objected to the processing of their data and smarterion is considering whether its legitimate grounds or those of the person take precedence. smarterion shall inform the data subjects before the restriction of processing is lifted.

16.5 Right to data portability
You have the right to obtain and reuse your personal data for your own purposes for various services. This applies to the personal data provided to smarterion. In return, smarterion will provide you with this information in a structured, commonly used and computer-readable format. Where (and if) technically feasible, you have the right to request that your personal data be transferred by smarterion directly to another data controller.

16.6 Right to object
In case of disagreement with processing activities You may at any time object to the processing of your personal data if it is used for direct marketing purposes (including profiling), based on smarterion’s legitimate interests (including profiling) and for statistical purposes. After receipt of such a request, the processing of personal data ends.

smarterion has the right not to fulfil such a request under the following conditions

  • If the compelling legitimate grounds for the processing override the interests, rights and freedoms of the individual to stop it.
  • If the processing is necessary for the establishment, exercise or defence of a legal claim With regard to automated decision-making processes
  • You have the right to ask smarterion not to subject you to decisions based solely on automated processing (including profiling).

smarterion may use automated decision-making processes if they are necessary for the conclusion or fulfilment of a contract, if they are permitted by law or if they are based on the express consent of the person concerned.
